Terms and Conditions

1. Our Agreement With You
Products and Suppliers
We sell a variety of travel services, accommodation in apartments, hotels or hostels; transfers from the airport, etc. owned or offered by our partners (“Suppliers”). Every apartment is displayed as a single listing on our website(s). We are responsible to display correct information online in order to provide the quality service to our guests. However, we are not responsible for possible wrong published information due to an error in typing. Prices published on the website are applied for out of season bookings. Seasonal prices for June, July and August can be different and are not published on our website(s), since in those months price is different from week to week. Please contact us with your travel dates and we will send you an exact price.
Booking with us is simple and fast. First, you send us an inquiry through any of contact forms on our website, and we reply with available options and prices. When you decide to book we will send you an offer with information about the exact apartment you are booking, prices and fees applied, and information about deposit payment. After a deposit is paid for your booking is confirmed and we will send you a Voucher. Voucher is official proof of booking. Please keep your Voucher handy during check-in, either printed on paper on your phone or tablet.
Deposits and Payment
There are two payment options when booking with us: you can pay full amount up front to confirm the booking or you can pay a deposit to confirm the booking, and pay the rest amount any time until 30 days before arrival date. Deposit is 50% of total cost unless stated otherwise in our offer. Please keep in mind that booking is confirmed after cleared payment, and we can guarantee apartment availability only after payment is cleared.
Our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you make a request for such documents to be sent as a hard copy.
Cancellations and Changes
If you cancel your booking anytime after confirmation, until 30 days before arrival, you will receive a refund of 50% from total price. If you cancel your booking 30 days before arrival or less, there is no refund. We might charge you for payments processing fees when making a refund. For airport transfers no refund is available. No show reservations are non-refundable and must be paid in full. For all other details our Cancellation Policy applies.
By booking an apartment you are agreeing to be bound by house rules stated on the website and/or in the apartment. Some apartment owners require a security deposit that will be returned to you upon check-out. Deposit amount will be stated in voucher or on apartment page. Please make sure you have a deposit ready on check-in. During your stay in an apartment(s) please make sure to follow house rules. In the case of any problem, you can always contact us.
In extremely rare situations where you are not following house rules and your behavior is having an impact on other guests in the house and their safety or ability to rest (i.e. extreme noise, party in the house, non-compliance with house manager warnings, etc.), we keep the right to decline further service. You will be warned about your behavior by house manager well in advance and will be given several opportunities to follow house rules before service is terminated. In case you need any assistance or want to speak to us, please give us a call. In case service is terminated because of your non-compliance with house rules, no refunds are made whatsoever.
Damage to apartment property
By booking an apartment you are agreeing to be responsible for any possible damage to the apartment or house property during your stay, no difference if the damage is made by you or any other person that you let in the apartment. It is strongly recommended to check apartment for any damages on check-in and point them to house owner/manager. House owner/manager will check the apartment on checkout and in a case of any damage, you will be held responsible. Please try to keep calm in situations like this, and contact us immediately so we can solve the problem for everyone.
2. Your Agreement With Us
Your Acceptance of these Terms and Conditions
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation, (b) your forfeiture of any monies paid for your reservation, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.
You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services or website by you and those using your name or account.
If You Cancel or Change Your Booking
If you cancel your arrangements, you may be entitled to a partial refund. If you decide to cancel arrangements before the balance due date, any deposits paid are non-refundable. Refer to our cancellation policy.
If You Have A Complaint
If you have a problem during your holiday, please inform the house/hotel/hostel owner or representative immediately. Should they be unable to resolve the matter, please immediately contact us. If you fail to timely contact us, we will not be permitted the opportunity to investigate your complaint and attempt to rectify any error while you are away, and this may affect your rights under this Agreement.

We will answer to all your complaints not later than 15 working days.
Travel Documents and Destinations
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately. Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.
Prior to booking international travel, we recommend that you review any prohibitions, warnings, and advisories applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.
Passport, Visa and Immigration Requirements
It is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.
Travel insurance is a vital part of your arrangements. We strongly recommend that you have taken out adequate insurance for the duration of your journey. We are not responsible to arrange an insurance for you, that is your decision only.
Use of our Services and Website
You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law.
Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any “robot”, “spider” or other automated or manual device or program, (b) deep link to any portion of our website, or (c) “frame” or incorporate any portion of our website into any other website.
Our website may contain links to third party websites that we provide only as a convenience to you. You should take precautions to ensure that whatever links you access are free of viruses, worms, trojan horses or other destructive mechanisms The existence of these links does not imply that we endorse such websites or any included content. We are not responsible for such websites or content or any data privacy practices of such websites.
You agree to indemnify us, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

Warranties, Disclaimers, and Limitation of Liability
THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED BY US OR PUBLISHED ON OUR WEBSITE MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING PRICING ERRORS. WE DO NOT GUARANTEE THE ACCURACY OF, AND DISCLAIM ALL LIABILITY FOR ANY ERRORS OR OTHER INACCURACIES RELATING TO SUCH INFORMATION THAT APPEARS ON OUR WEBSITE. WE EXPRESSLY RESERVE THE RIGHT TO CORRECT ANY PRICING ERRORS ON OUR WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH EVENT, IF AVAILABLE, WE WILL OFFER YOU THE OPPORTUNITY TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE OR WE WILL CANCEL YOUR RESERVATION WITHOUT PENALTY.
WE MAKE NO GUARANTEES ABOUT THE AVAILABILITY OF SPECIFIC PRODUCTS AND SERVICES. WE MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES PROVIDED BY US OR CONTAINED ON OUR WEBSITE FOR ANY PURPOSE. THE INCLUSION OR OFFERING OF ANY PRODUCTS OR SERVICES BY US DOES NOT CONSTITUTE OUR ENDORSEMENT OR RECOMMENDATION OF SUCH PRODUCT OR SERVICE. IF, DESPITE THE LIMITATION ABOVE, WE ARE FOUND LIABLE FOR ANY LOSS OR DAMAGE WHICH ARISES OUT OF OR IN ANY WAY CONNECTED WITH ANY OF THE OCCURRENCES DESCRIBED ABOVE, THEN OUR LIABILITY WILL IN NO EVENT EXCEED, IN THE AGGREGATE, THE GREATER OF (A) THE SERVICE FEES YOU PAID TO US IN CONNECTION WITH SUCH TRANSACTION(S) ON THIS WEBSITE, OR (B) ONE-HUNDRED DOLLARS (US$100.00) OR THE EQUIVALENT IN LOCAL CURRENCY.
THE LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN THE PARTIES. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
We reserve the right at any time to modify this Agreement without prior notice to you. Please refer to our website at zrce-novalja.info from time to time to review the most current version of the Agreement. Your continued access or use of our website or services signifies your acceptance of the modifications to the Agreement. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.
This Agreement shall be governed by the laws of Croatia without regard to its conflicts of laws principles. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.

Information Collection, Use, and Sharing
We are the sole owners of the information collected on this site. We only have access to collect information that you voluntarily give us via email or other direct contact forms. We will not sell or rent this information to anyone.
We will use your information to respond to you, regarding the reason you contacted us. We will not share your information with any third party outside of our organization, other than as necessary to fulfill your request, e.g. booking an apartment, airport transfer, etc.
Your Access to and Control Over Information
You may opt out of any future contacts from us at any time. You can do the following at any time by contacting us via the email address or phone number given on contact page:
- See what data we have about you if any.
- Change/correct any data we have about you.
- Have us delete any data we have about you.
- Express any concern you have about our use of your data.
We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline.
While we protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.
We request information from you on our order form. To buy from us, you must provide contact information (like name and address, etc.). This information is used to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.
We are using cookies to give you the best experience on our site. Cookies are files stored in your browser and are used by most websites to help personalize your web experience. Usage of a cookie is in no way linked to any personally identifiable information on our site.
We share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.
We use an outside credit card processing company to bill users for services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order.
We partner with property owners and other companies or individuals to provide specific accommodation, transfer, and other services. When the user signs up for these services, we will share names or other contact information that is necessary for the third party to provide these services. These parties are not allowed to use personally identifiable information except for the purpose of providing these services.
This web site contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collect personally identifiable information.
Surveys & Contests
From time-to-time, our site may request information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.
By sending an inquiry or downloading an eBook you agree to be added to our mailing list. We promise to keep your email private and will not ever share it with third party. It can only be used to send the newsletter regarding our services and Zrce beach news. We will never spam you and you can always unsubscribe following an instruction in the email received. If you want us to remove your email from the list please get in touch here.

For specific bookings, different cancellation policies may apply, but if not stated otherwise in your voucher this policy applies for all bookings.
For airport transfers bookings no refund is available.
We might charge you for payments processing fees, our transaction costs and foreign exchange fees when making a refund.
By booking an apartment you agree to be bound by Happy Island d.o.o. travel agency general House Rules and specific House Rules for the apartment/house in which you are staying. Below you can find our general House Rules:
- Keep your apartment keys safe. House manager and you are the only ones having access to the key. If you lose your key please contact house manager or contact us immediately.
- Make sure you are aware of other people in same house or houses near by and respect their privacy.
- Do not make any noise or listen to loud music at night (from 10 PM to 8 AM) and keep it moderate during the day.
- Apartments are not in the party zone. Make sure you respect the property and house managers/house owers at all time.
- Leave the apartment in the state it was found. Before check out please wash the dishes and take out the trash. In case apartment needs special cleaning you may be charged for that.
- Security deposit is required in most apartments. The exact amount is specified on each apartment page and/or in your voucher. Deposit is paid in cash on check-in. House manager will return the deposit to you in cash on checkout.
- Please check apartment for any damage on check-in, before you pay the security deposit and notify house manager immediately.
- You are responsible for damage to apartment property. House manager will check apartment for damage on checkout, and if there is a damage security deposit is used to cover it. You are responsible to pay for damage that exceeds deposit amount.
- The travel document is required (passport or national ID card) on check-in. House manager will return the document to you shortly or he can make a copy or take a picture of a document for legal obligations of tourist reports.
